Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the websites, newsletters, podcasts, advertiser tools and any related services operated by The Techbull (the “Services”). By using the Services, you agree to these Terms. If you don’t agree, please don’t use the Services.
Specific features have their own additional terms which are part of this agreement: Advertising Terms, Privacy Policy, Cookie Policy, Editorial Policies, and Copyright & DMCA.
Eligibility
You must be at least 16 years old (or the minimum age required in your jurisdiction) to use the Services. If you’re using the Services on behalf of an organisation, you represent that you have authority to bind that organisation.
Your account
- You’re responsible for keeping your password safe and for everything that happens under your account.
- Tell us promptly via our contact page if you suspect unauthorized access.
- One person, one account. Sharing logins is not allowed.
- We may suspend or terminate accounts that violate these Terms, applicable law, or our community standards.
Acceptable use
Don’t:
- Use the Services to harass, defame, threaten, or impersonate others.
- Scrape, mirror, or systematically copy our content without permission. RSS feeds are provided for personal use; AI training-data crawlers are not authorized.
- Probe or attack our infrastructure, attempt to bypass rate limits, or interfere with other users.
- Upload anything illegal, malicious, or that infringes someone else’s rights.
- Use the Services to send spam, including via our newsletter signup or contact forms.
Our content
Articles, newsletters, photos, illustrations, podcasts and audio belong to The Techbull or our contributors and licensors. You may:
- Read and view the content for personal use.
- Share excerpts (under 300 words) with a link back, as fair use / fair dealing allows.
- Embed our official social posts and clearly-labeled embeds.
You may not republish, syndicate or redistribute full articles without written permission. To license content for republication or training, write to us via our contact page.
Your content
If you submit content (a comment, a tip, a press release, a creative asset for an ad), you keep ownership and grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, modify (for formatting), publish and display it as needed to operate the Services. You confirm you have the rights to grant this licence.
We can remove content at any time, particularly content that violates these Terms or applicable law.
AI training and machine readers
Without our prior written consent, you may not use the Services or content from the Services to train, fine-tune or evaluate machine learning models, large language models, retrieval-augmented systems, or any successor technology. Our robots.txt and the x-robots-tag headers we serve reflect this position. To licence content for these purposes, contact us.
Paid services
Advertising bookings, newsletter sponsorships and any future paid memberships are governed by these Terms plus the applicable additional terms (see Advertising Terms). All prices are exclusive of taxes unless stated. Payments are processed by PayPal (USD/EUR) or Pesapal (KES, mobile money, African cards). We do not store card numbers.
Refunds & cancellations
For ads, refunds and make-goods are governed by the Advertising Terms. For one-off purchases not covered there, refunds may be granted at our discretion within 14 days of purchase if the service has not been substantially delivered.
Third-party services
Some features rely on third parties (Pesapal, PayPal, Resend, Cloudflare, etc.). Those services have their own terms and privacy policies. We’re not responsible for what third parties do with the data you give them directly.
Disclaimers
The Services are provided “as is” and “as available”. We make no warranty that the Services will be uninterrupted, error-free, or meet your specific requirements. Editorial coverage is reported in good faith and is not investment, legal, tax or medical advice. Always do your own research.
Limitation of liability
To the fullest extent permitted by applicable law, neither The Techbull nor our directors, employees, contributors or licensors will be liable for indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services, even if we’ve been advised of the possibility. Our total liability for direct damages is capped at the greater of (a) the amount you’ve paid us in the preceding 12 months for the relevant Service, or (b) USD 100.
Nothing in these Terms limits liability for fraud, gross negligence, willful misconduct, or anything that cannot legally be limited.
Indemnity
You’ll indemnify and hold The Techbull harmless from claims arising out of (a) your breach of these Terms, (b) your violation of law or third-party rights, or (c) content you submit.
Termination
You can stop using the Services at any time. We can suspend or terminate your access if you violate these Terms or if continuing to provide the Services to you would expose us to legal risk. Provisions which by their nature should survive termination (intellectual property, indemnity, limitations of liability, governing law) will survive.
Changes to these Terms
If we change these Terms materially, we’ll post a notice on the site and notify account holders by email at least 14 days in advance. Continued use after the effective date means acceptance.
Governing law & disputes
These Terms are governed by the laws of the Republic of Kenya, without regard to conflict-of-law principles. Disputes will be resolved exclusively in the courts of Nairobi, Kenya — except that either party may seek injunctive relief in any court of competent jurisdiction. If you’re a consumer in the EU, UK or another jurisdiction with mandatory consumer-protection rules, those rules continue to apply to you.
